This page is for founders, game studios, agencies and operators who are thinking of hiring a real money game development company and want to know what is still lawful to build. After reading it you should be able to decide whether your idea is a prohibited online money game in India, which lawful formats you could build instead, and which questions to put to any vendor before you sign.
It is not for anyone planning to launch a cash-stake game for Indian users, and it does not answer the player question "which game makes real money". We do not recommend any game or market for earning, and nothing here promises winnings, returns or income. This is general information, not legal advice; ask a qualified lawyer about your own case. If you already know your format and want to talk to us about a lawful build, see our gaming website development services at /services/gaming-website-development or reach us at /contact.

What is real money game development?
Real money game development means building a game or a platform where players pay or stake money and can win money or something that works like money. The build is more than the game itself. It is a game engine plus a wallet and ledger, KYC and age verification, fair-play controls, payout handling and admin tools that let the operator see and control what is happening.
People who search this phrase are mostly operators, studios and agencies looking for a white-label vendor. A large share of the same searches come from players and students asking how to earn from games. That is a different intent. This page does not tell anyone how to earn, and it cannot promise that a game will pay out.
In short: this page is for builders deciding what to make, not for players, and not for anyone who wants to launch a cash game aimed at Indian users. Section 2 explains why.
Is real money gaming legal in India now?
No, not for online money games. Parliament passed the Promotion and Regulation of Online Gaming Act, 2025 on 20-21 August 2025 and it received assent on 22 August 2025. The Ministry of Electronics and Information Technology (MeitY) notified the Promotion and Regulation of Online Gaming Rules, 2026 on 22 April 2026, and the Act and Rules came into force on 1 May 2026 (Medianama; Legal 500, 2026).
Under the Act, an online money game is prohibited whether it is a game of skill or a game of chance, and published legal summaries say no licence or registration route exists for it. Formats such as fantasy, rummy and poker are reported to fall inside the definition. This is the Section 5 prohibition that overseas-market questions below keep returning to. The Act also bars banks and payment providers from processing transactions for such games.
As reported by Legal 500, the penalties are up to 3 years in prison and INR 1 crore for offering or facilitating an online money game, and up to 2 years and INR 50 lakh for advertising one, with offences cognisable and non-bailable. Treat these as a reported summary and read the Act text itself before relying on any figure.
To decide whether a particular game is an online money game, the Online Gaming Authority of India (OGAI) looks at stakes, the expectation of winnings, the payment structure and whether rewards can be redeemed outside the game (Rules 8-9, as summarised by Medianama). A "skill" label alone does not settle the question.
Constitutional challenges to the Act are pending in the Supreme Court, and in August 2026 it was reported that a final hearing had been agreed. We have not predicted the outcome. The position described here was checked on 17 October 2026; please check the current status before you act.
Brandzivio builds software only. The client is responsible for licences and compliance in their market, and this is not legal advice.
What can you still build instead of a real money game?
Many of the technical pieces behind a money game are also useful in lawful formats. The table compares the common models on the same four points. India positions are as reported by Legal 500 and Medianama, checked on 17 October 2026; confirm with counsel for your specific design.
Rule 12 allows the Centre to require registration of notified categories of social games, so the position for social games can change. Rewards that can be redeemed or transferred outside the game may be treated as money, so check any reward design with a lawyer before building it.
| Model | Money staked? | India position | Typical build |
|---|---|---|---|
| Online money game (cash entry, cash prize) | Yes | Prohibited, skill or chance | Not built for Indian users |
| Free-to-play casual or puzzle game | No cash in or out | Generally permitted as a social game | Game portal, accounts, leaderboards |
| Subscription or one-time-fee social or educational game | Fee for access, not a stake | Generally permitted per Legal 500 | Game or learning app with payments for access |
| E-sport tournament platform | No wagering; prize money for performance | Permitted, but registration is mandatory; spectator betting is not allowed | Tournament brackets, player profiles, admin tools |
Can an Indian company build real money games for overseas markets?
The honest answer is that this is unresolved. In October 2025, industry lawyers told Storyboard18 that the wording of Section 5 leaves it unclear whether Indian firms can supply software, or run support centres, for foreign platforms operating wholly outside India. The government has said it wants to support exports, but that is stated intent, and we did not find it written as a rule in the 2026 Rules text. We are not saying it is allowed, and we are not saying it is banned.
If you are considering this route, get a written opinion from Indian gaming counsel covering Section 5, the 2026 Rules and the foreign-exchange and overseas direct investment (ODI) rules, and separate advice from counsel in the target market.
Licensing per jurisdiction is how this works everywhere else. The operator, not the software vendor, holds the licence, for example from the UK Gambling Commission or, for skill contests, from individual US states. Where a market asks for it, games with random outcomes are tested for RNG certification by an independent test lab. Ask which lab and get the certificate, rather than accepting "recognised labs" as an answer.
To be clear: Brandzivio does not offer cash-stake game builds for Indian users, and this page does not recommend any market.
What features does a lawful game platform need?
The list below is general buyer guidance on what a game platform usually needs. Several items matter even for a cash-free game, which is why the build stays useful in lawful formats. Payment features must also match what banks and payment gateways allow, and any platform that stores player data must follow the DPDP Act for personal data.
- User accounts with OTP login, so each player is a verified, unique person.
- A wallet and ledger with double-entry records, needed whenever the platform holds any balance, points or credits.
- KYC and age verification where the market requires it.
- Geo-fencing and market blocking, so the product is not offered where it is not allowed.
- RNG and game-state integrity checks wherever outcomes are random.
- Anti-fraud, bot and collusion checks, which matter in leaderboards and tournaments too.
- Audit logs and admin roles protected by multi-factor authentication.
- Responsible-play limits and self-exclusion where the format involves spending.
- Reporting and reconciliation for finance and support teams.
- A real-time engine using WebSockets, with reconnect handling for dropped connections.
- For reference, the gaming platforms Brandzivio builds include a lobby, accounts and wallet, leaderboards, tournaments and rewards, a secure real-time engine, an admin panel with reporting, and anti-fraud and audit logs.
How much does real money game development cost?
Published market ranges are vendor estimates in US dollars, not independent data. Source Code Lab's cost guide (updated August 2026) lists a casino-style platform at $85,000-$120,000 for a basic 10-15 game platform and $150,000-$300,000+ for enterprise scale. The same guide prices compliance architecture at $25,000-$60,000, payment integration at $15,000-$35,000 and testing and certification at $8,000-$25,000 per game. Other vendors quote $15,000-$150,000+ for simpler products. Treat all of these as published vendor estimates for 2026.
The ranges are wide because the price depends on the number of games, concurrent players, payments, KYC, certification, the number of jurisdictions, live-dealer or multi-market support, and ongoing hosting and security.
For comparison, Brandzivio's own indicative range for gaming website development is Rs 2,00,000 - Rs 12,00,000 over 6 - 16 weeks. That covers gaming websites and platforms with a lobby, wallet, leaderboards and admin tools. It does not include licences, certification or legal fees, and it is a different kind of product from the vendor estimates above, so do not read the two as like for like.
Costs buyers often forget are licensing, a written legal opinion, test-lab certification, payment-provider approval and ongoing compliance work.
How to choose a game development company: questions to ask
This is advice for the buyer, whichever company you hire. It is not a list of what Brandzivio commits to.
- Which law and which market are you building this for, and can you show where that is written down?
- Will you accept a build that I cannot lawfully launch? A good vendor should say no or raise the problem first.
- Who holds the licences? It should be the operator, with clear responsibilities in writing.
- Agree code and IP ownership in writing before work starts.
- What will you not promise? Winnings, returns and player retention should never be guaranteed.
- How are RNG and fairness tested, and by which independent lab?
- How are payment and KYC providers chosen, and who signs the agreements with them?
- What is the support and security-update plan after launch?
- Can I verify your references myself?
- Red flags: "clone of a famous app" pitches, guaranteed income, advertising of cash games aimed at Indian players, unnamed "recognised labs" and unverifiable "100+ games delivered" numbers.

Frequently asked questions
Is real money gaming legal in India now?
No, not for online money games. The Promotion and Regulation of Online Gaming Act, 2025 and the 2026 Rules came into force on 1 May 2026 and prohibit them whether the game is skill or chance. A Supreme Court challenge is pending, so check current status. This is not legal advice.
Can an Indian company build real money games for foreign markets?
It is unresolved. Industry lawyers said in October 2025 that Section 5 leaves it unclear whether Indian firms may supply software to foreign platforms operating wholly outside India. Get a written opinion from Indian gaming counsel, including on ODI rules, plus advice from counsel in the target market.
How much does it cost to develop a real money game?
Published vendor estimates for 2026 run from about $15,000 for simpler products to $85,000-$120,000 for a basic casino-style platform and $150,000-$300,000+ at enterprise scale. Licences, legal opinions and certification are extra. Brandzivio's indicative range for gaming websites is Rs 2,00,000 - Rs 12,00,000.
What features does a real money game platform need?
Typically accounts with OTP, a wallet and ledger, KYC and age verification, geo-fencing, RNG integrity checks, anti-fraud controls, audit logs with admin roles, responsible-play limits, reporting and a WebSockets real-time engine. Comply with the DPDP Act for personal data, and with what payment providers allow.
What is the difference between a game of skill and a game of chance?
In a game of skill, the player's knowledge and decisions mainly decide the result; in a game of chance, luck decides it. In India this no longer settles legality for money games, because the 2025 Act prohibits online money games either way. A skill label is not a safe harbour.
What can I build instead of a real money game in India?
Free-to-play casual or puzzle games, subscription or one-time-fee social and educational games, and e-sport tournament platforms are generally treated as permitted, with e-sports needing registration. Leaderboards and non-cash rewards are common. Check reward design with a lawyer. Developer pay varies widely, and this page gives no figure.
